Drones and privacy

You've probably noticed that more and more people are flying their drones all over the place, whether in public or private places, in town or country. And did you know that the vast majority of these flying devices have a camera with which they can take photos and videos?

So it makes sense to ask the following questions:

1.      Is there a limit to how far you can go?

2.      If so... Are there rules in place to ensure that everyone's privacy is protected?

To answer the first question, we could say: your freedom ends where others' begin! Yes, but... how do we define the limit of others? In this article, we'll try to demystify this question so that it's as clear as possible to anyone reading this.

Here are afew basic rules for all drone pilots:

1.      If you are likely to capture images containing personal information during your flight, you must obtain authorization from the people concerned. For example, if you plan to fly near the entrance to a restaurant, you could inform the owner a few days in advance.The owner could even put up a sign in full view of his customers to warn them.

2.      Do your best to limit the amount of personal data in your photos or videos so that it's impossible to establish the identity of the person whose personal information you've collected without consent. For example, blur faces or license plates.

3.      Be a responsible pilot. You are solely responsible for the personal information collected by your drone (a person's name, a photo of their face or license plate.) Being responsible also means keeping information containing personal information secure by taking steps to ensure that you are the only person who has access to it.

4.      Be open and explain what you're doing. If someone complains that the use of your drone is invading their privacy, respond with respect and courtesy.

Invading someone's privacy could lead to criminal charges relating to :

o voyeurism;

o mischief;

o causing a nuisance; and/or

o violation of provincial or municipal laws.

You may also be subject to one or more fines:

o Individual: between $1,000 and $3,000

o Legalentity: between $5,000 and $15,000
